These Terms and Conditions (“Terms”) govern your use of the Eighty8Awards website (the “Website”) and your participation in the Eighty8Awards program (the “Awards”). By submitting an entry, you agree to be bound by these Terms.
1. Eligibility and Entry Rules
1.1 Eligibility
The Awards are open to individuals that meet the specific Eligibility Criteria outlined for each category. We reserve the right to verify the eligibility of all entrants and entries. Submitting an entry warrants that you meet all eligibility requirements.
1.2 Entry Materials and Format
All entries must be submitted through the official entry platform on the Website and follow the format, word count, and file requirements specified for the relevant category.
- Late Submissions: Entries must be submitted before the application window closes. Late submissions may be accepted only at our sole discretion and may be subject to a late fee.
- Incomplete or Non-Compliant Entries: We reserve the right to disqualify entries that are incomplete, non-compliant with the submission requirements, or that contain content we deem inappropriate or offensive.
2. Intellectual Property and Usage Rights
2.1 Ownership of Work
You retain all Intellectual Property Rights (IPR) in the original work you submit. Your entry and all accompanying materials must be your original creation.
2.2 Grant of License
By submitting an entry, you grant Eighty8Awards, Eighty8 Gives, its partners, and sponsors a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and publish the entry materials (including names, company names, project descriptions, and submitted media) for the following purposes:
- Judging and Administration: Sharing with judges, staff, and contractors for the purpose of evaluation, administration, and marketing.
- Promotion and Publicity: Publicizing the Awards, winners, and shortlisted entries on the Website, in press releases, social media, and in future promotional materials.
- Archival: Retaining a copy of the submission for archival and historical purposes of the Awards.
2.3 Required Clearances
You warrant that you have obtained all necessary licenses, permissions, and releases for the content, persons, and/or entities featured in your submission, and that our use of the entry materials will not infringe upon the rights, including IPR, of any third party. You agree to indemnify Eighty8Awards against any claims arising from the breach of this warranty.
3. Judging, Decisions, and Publicity
3.1 Judging Process and Confidentiality
- Entries will be judged by a panel of industry experts. The judging criteria are outlined on the Website.
- The judges’ names may be published on the Website.
- We make reasonable efforts to maintain the confidentiality of non-public entry details, but judges, like any human, can be fallible. We make no absolute guarantee of confidentiality, and you should ensure that the materials submitted contain no information that is strictly prohibited from disclosure.
3.2 Final Decision
The decisions of the judging panel, EIghty8 Gives, and Eighty8Awards regarding all aspects of the Awards, including eligibility, judging, and winners, are final and binding. No correspondence or discussion will be entered into concerning the final decisions, judging process, or results. We reserve the right not to grant an award in any category if, in the judges’ opinion, no entry meets the required standard.
3.3 Publicity for Winners
If you are selected as a winner or a shortlisted entry, you agree to cooperate with the Awards in any reasonable publicity or promotional activities related to your win. You agree to use the official Eighty8Awards logo or mark only in accordance with our usage guidelines.
4. Limitation of Liability and Indemnification
4.1 Limitation of Liability
Eighty8Awards will not be liable for any entries that are lost, delayed, damaged, or misdirected due to technical malfunctions, system failures, or any other cause. To the maximum extent permitted by law, Eighty8Awards, its affiliates, and its judges shall not be liable for any direct, indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill) arising from your participation in the Awards.
4.2 Indemnification
You agree to indemnify, defend, and hold harmless Eighty8Awards, its officers, directors, employees, agents, and judges from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to your breach of these Terms, including but not limited to any claim that your entry materials violate the intellectual property or proprietary rights of a third party.
5. General Provisions
5.1 Privacy Policy
Your submission of Personal Information is subject to our Privacy Policy, which is incorporated into these Terms by reference. By submitting an entry, you consent to the collection, use, and disclosure of your Personal Information as outlined in the Privacy Policy.
5.2 Modification and Cancellation
We reserve the right to modify, suspend, or cancel the Awards or any category at any time for any reason, including, without limitation, a lack of sufficient entries, technical difficulties, or circumstances beyond our control. In the event of modification or cancellation, we will notify entrants via the Website or email.
5.3 Entire Agreement
These Terms, along with the official Awards Guidelines and Privacy Policy, constitute the entire agreement between you and Eighty8Awards concerning your participation in the Awards.
